    Default breaks/lunches at work..question regarding the laws.

    i can't find any info. and you guys rock it when it comes to this stuff.
    dh needs to find out.. what the laws are in regards to the time alotted for breaks and lunches. he works 11:45-6:15=6.5 hours.. currently with NO breaks/lunch.

    I think if you work 8 or more consecutive hours you get either a half hour lunch plus two 15 minute breaks OR an hour lunch. More than 5 hours but less that 8 they only have to give you a 15 minute break.

    ETA some professions are exempt from this law where it isn't practical to leave or a 15 minute break.

    ok so say. you work 6.5 hours but are CONSIDERED full time.. you should be allotted TWO 15 minutes breaks. OR ONE 30 minute lunch??

    he was told he can eat as long as he's alone. im not going to get into great detail about this.. due to confidentiality reasons. but if he's nearly never alone. and literally had 4 minutes yesterday to 'go'.. in a 6.5 hour day. this isn't right.. if he does decide to fight this.. he want's to make sure he has his facts straight.. unfortunately. if he can't change the working conditions he's facing right now... he's not staying.

    Its 5 hours and you get a 30 min unpaid break or 2 15 min breaks. Paid if they require you to stay on property.

    They are not required to give you a 15 min break other than the 2 15 mins that you get instead of a 30 min break.

    not so worries about the pay.. just would like to see him get a break..poor dude.. he hates this job already.. 2 days in. is crazy.. and thats being really REALLY nice.

    DH has worked 13 hrs with no break. I know it isnt legal and he would get one if he requested it. In his environment though the customer isnt going to be too sympathetic if their food take 30-45 min because one of the cooks was on break.

    see P. thats the thing. he did request a break.. he was told ONLY if your alone.. but in his line of work. hes' NEVER alone. if he is..its literally for NO more than 5 minutes. and thats his 'go' break. if you get my drift..he's managing somehow . as he eats a BIG breakfast before he leaves. and takes a small snack he eats IF he gets a second. just a screwed up position he has. no wonder they were desperate to fill it with him. poor DH.

    Where I work we get a :

    15 minute paid break for any shift up to 5 hours
    1/2 hour unpaid break for working 5 - 6 hours
    1/2 hour unpaid break and paid 15 minute break for working 6 - 7 hours
    1 hour unpaid break and 2 paid 15 minute breaks for any shift over 7 hours....

    On Sundays...if we work a 7 hour plus shift and take the one hour lunch...we get paid for half of it...

    Sorry your dh is experiencing this and he just started this job too...that is crappy.

    When I worked at M&M you worked alone most of the time and you only got a break when there was noone in the store. Just a different point of view.

    Legally they need to provide a 30 min half hour UNPAID break for a 5+ hr shift (acording to DH, I havent looked it up).
