    Default Court Form Help

    We are heading back to court with DH's ex for more access of DSS and our lawyer has given us a Form 13 (Financial form) to fill out. She is not claiming undue hardship so I know since my income doesn't come into play at all.

    1) Do I only include DH's income
    2) How do I figure out expenses sine we shar everything...split everything in the middle rent, groceries, etc.
    3) Do I not split some things because they are not technically my debt? (ie child support, OSAP, money spent on child's clothing and activities?

    I've asked two people and have gotten two different answers so any advice would be appreciated.

    You don't include your income, but you do include all expenses for your household.

    I need to call our lawyer tomorrow and ask some stuff, do you want me to ask her too?
    I know I told you what I did when we were self-represented, but I can just double check it's right (or wrong)?

    That would be awesome Kaisa...thank you...I just want to get this thing done and over with I would call our lawyer but he's on holidays this week and I would love to have it faxed to him before he returns.

    But thats going to make it very screwed though isn't it....

    example (not using our real number but just for an example): income for him is 2000
    rent is 800
    groceries is 400
    car payment and insurance for two cars 500
    child support 200
    OSAP 100
    debt repayment 500

    so we're already at 2500 and thats not including phone, cell, internet, clothes, gifts, activities, gas etc.

    If I did it that way it would make it look like DH is going thousands of dollars in debt a month

    When I had a job our lawyer to that into account when listing things like if I made a 1/4 of SOs pay he took off a 1/4 of rent and 1/4 of groceries until my income was gone and then the bills were in full for the rest and his debt was his
    ...and in that moment I swear we were infinite.

    In case anyone was interested in knowing...I found out the answer.

    Since me and DH make pretty much the same split the expenses in half (I make a bit more but not enough to justify splitting it differently).

    And then figure out who's debt is whos and if there his put them down. Example the good car is his since he needs a reliable car to get DSS and take him home (out of town). I don't need a reliable car I prefer beaters as I just go around town and if it broke down I would be fine to live my life with the bus. And of course all expenses related to DSS (clothing, activities, entertainment, gifts) go under DH 100% in the Financial Statement.

    Looks like Ill be busy tonight.
