Oh Foxi, I'm so sorry you're going through all of this. I wish I had something more comforting to say.

He is likely sueing now because there is a 2 year statute on car accidents.

I'm so sorry that you are going through this. He will have to prove all of his claims and hopefully it goes the same way your last court appearance did.

Wow, I'm SO sorry this is happening to you. It sounds like the LAST thing you need to deal with right now and I really hope it gets sorted for you quickly. How upsetting that after all of this time (and what seemed like an 'old and settled' issue) its come back to you like this. I'm not sure as to what legality he has or anything about suing but I hope someone here can give you suggestions to help make this a thing of the past- and quickly. Good Luck and remember to take care of yourself and not let this ruin the joy of the baby's arrival!!

I dont know what to say other than get a good lawyer and look into the laws about how long after an incident they have to sue you. Sorry you are going through this. =(

    Oh theres the info already!
I would agree they are taking a stab at it incase they could get something. I bet with the economy being what it is, they are having money issues and see this as a solution.

    WOW. That sucks!!
Soooo sorry to hear you are dealing with this right now.
Some pple are just out for money, plain and simple.
If the guy was not hurt after the accident and it took months and months for him to “start hurting“, it sounds like crap to me.
Not much advice, but hope it works out in your favor...

My parents and sister went through something similar years ago. The insurance company took care of it, and settled out of court, just to get the lady to go away. She was sueing for $1.53 million and really had no case, but it would have cost insurance a lot of money in lawyer fees if they went to court, so they settled. It kinda sucked because we were hoping that she would get nothing, since she flat out lied too.

I'm so sorry that you're going through this. I hope that insurance takes care of everything for you, and this goes away soon!

ETA - My sister went to court for a following too closely charge, and it was dismissed, and she was still sued. And the lady who sued us later, she was in court, and testified that my sister wasn't following too close!!!!

I'm sorry Foxi, certainly not a stress you needed. 2 years is a long time and it does sound really sketchy to me. 2 years after a fender bender? Wow. I'm even surprised you had to go to court over it. Is that normal? What a waste. I was in an accident in December and haven't heard anything about court. Anyway, Hopefully it will be resolved quickly in your favour. Don't let it get to you or ruin your happiness.

That sucks but if you proved it once can't you prove it again? If there was NO damage done to his car then how can he be injured. I was in an accident with a pole and my whole jeep was a write off and I am 100% ok. Even the pole was splintered.

    Good Luck
